MACC — My many questions!

tiong KSThe Star headline on Sunday reported that MACC officers went to Tiong King Sing’s office and interviewed him from 2 pm until 6.30 pm in the presence of Tiong’s lawyers.

Why was Tiong NOT summoned to the MACC HQ and denied legal assistance, as was done against several aides to DAP dignitaries in Selangor?  Why was Tiong not summoned in the evening and questioned for 10 hours till early the next morning in the way Teoh Beng Hock was interviewed?

Why was Tiong not immediately arrested as a suspect, and if he resisted arrest, immediately beaten up, as was done to Wong Chuan How, personal aide to Ronnie Liew?

Is it because Tiong King Sing is a powerful Barisan National personality and a rich person in his capacity as the CEO of Kuala Dimensi Sdn Bhd, that he was given courteous treatment that was denied to those opposition people?

20041033The Star also carried a report in the same day on Page 4 a suggestion by MACC director of investigation Datuk Mohd Shukri Abdull that all investigations involving political cases be suspended.

I do not understand what he means by “political cases”, but from the way he grumbles and mumbles, it probably means those probes into the Selangor PR government people.  If so, I recommend that his suggestion be accepted by whoever is in charge in MACC.  If ‘political cases” include those connected to the PKFZ black hole, then I disagree.

By the way, pardon my ignorance, who is in charge in the MACC anyway?  Who is the top dog in that organisation?  To whom shall I complain if I suspect the MACC top dog of corruption himself?  Who is to guard me against the guard supposed to watch all the other guards?

Wong Chuan How’s arrest gives rise to even more questions.

How and why do the MACC people decide to initiate any probe into allegations of corruption?  Which person or branch inside the MACC says at any point in time, “Right, we open a file on this case and start investigating it.”  On what ground does he make such a decision?  Are there definite rules for such decisions to be made?

Najib_MACC400In the case of Wong’s arrest, when do the MACC officers turn from interviewing a witness into the arrest of a suspect?  Are there rules for this kind of decision, or is it entirely based on the officer’s personal whim and discretion, or the condition of his stomach?

By the way, again, how are these MACC officers recruited and based on what criteria?  Are they all graduates in criminology, or are they just SPM graduates?  How much are they paid? (You pay peanuts and you get monkeys.)  What kind of special training do they have in investigations into corruption cases?

Are these MACC officers well versed in laws and the Rule of Law?  Are they sensitised to increasing demands for respect for human rights and individuals’ civil liberty?  Are they trained in civility towards citizens and taught that everybody is innocent until proven otherwise in a court of law?  Are they literate?

Or do these MACC officers see themselves as part of the “Malay-dominated institutions” established to ensure Malay dominance in all things in Malaysia, as is the narrative in Utusan Malaysia?

Wong Chuan HowAbout the injury on Wong Chuan How’s legs during his scuffle with the MACC officers, the MACC has issued a statement claiming that Wong “fell to the ground himself”.  Ya, right!  Anwar punched himself on the famous eye to cause that infamous bruise himself while under police investigation ten years ago.  Teoh Beng Hock jumped from the window while being in the care of MACC.  The sun rises from the west every morning.

Finally, after all that public outcry, the MACC has belatedly formed a 30 member panel to investigate into the PKFZ scandal.  How many of you believe that they will come out with the truth behind all that swindling of billions from our public coffers?

The coercive powers installed on the police and the MACC officers by the State to arrest, detain and interrogate citizens are terrible powers, because they deprive citizens of their civil liberty and their basic rights.  The policemen and MACC officers must realise these powers are not their discretionary powers to be used at their whims and fancies.  They are not to be used because their egos are bruised.

Judging from the performance of the MACC so far, and after Teoh Beng hock’s death, can we truly give our full unqualified blind support to them in the exercise of those powers?

The MACC was established to weed out corruption in a kind of lame-duck reform to our corrupt society.  Now it looks like MACC – among all our institutions – is the most in need of reform!

  3. DPM muhideen lately used the nuri helicopter to Sabah to officiate one of he ammo division meeting. Can he used the government facility for ammo party matter. MACC please investigate.

  4. You gave too much credence to Monkeys Associated Corrupted Conglomerate (My sincere apology to the monkeys with tail). These MACC probably SRP drop-out. Why do you think they only target petty issue involving thousand ringgit like the late Mr. TBH (may he rest in peace), the cow offering case, need i list more?

    Mega cases with millions not to mention billions, something they can grasp the “dare not” tackle like the PKFZ, the Balkis fund, the Ex-Memang Bodoh who acquired wealth beyond his means and can still fart loudly.

    Even now the head of MACC plead not to investigate “politician”,

    Hopelessly hopeless, a prosperous nation ruined by Bee End.

  7. The MACC is a waste of time and money. It is blatantly obvious that they have one set of rules for the Opposition and another for BN. How can they claim to be neutral when they start on this premise? UMNO is using every agency and every means no matter how crooked to stay in power, aided and abetted by MCA, Gerakan, MIC, SUPP and the Dayak parties in Sarawak. Recently UMNO has been going all out to woo back the Malay heartland at the expense of marginalising the constituents of the component parties. Don’t these component parties feel used? Haven’t they got any pride left? Or have they sold their souls to UMNO for money?

  8. There should be a royal commission to look into these many royal commissions problems. Judge the judges’ judges or some sort of.

    Actually Mr Sim, the only thing lacking in MACC is mandatory death penalty. You may think China’s capital punishment is harse and inhumane but love to see those crooks be hanged or shot to death. Might as well the national fatwa council must declare officially rasuah as forbiddenly haram.

  10. When the AG’s knowledge of law is suspect and the IGP has not an iota of what beat policemen do cum DPM with a dinosaur mentality, what do u expect? MACC is neither professional nor credible! Look at the biodata of the staff, the organisation chart and ‘standard operating procedures’………ICAC in Hongkong capitalizes on integrity, dedication and professionalism to showcase their mission to eradicate corruption. MACC can only boast of blind obedience to the ruling party, play- acting cum ignorance of the highest level and dubious impressive qualifications!!!!!!You need Professor Higgins to come up with FAIR….God Bless And Help Malaysia!

      No cause is ever lost until we give up entirely in despair. We should do what we have been doing. knocking our heads against the UMNO bamboo curtain until it collapses. When we die, we make sure our children continue the war until the evil of corrupt politics is driven from our land.

    UMNO/BN and its political instruements like PDRM,MACC,SPR,and lots more dont give a damn thing to HUMAN RIGHTS,DEMOCRACY PRINCIPLES and RULE OF LAW. It is very disgusting indeed to see the way UMNO/BN digging racial and religious issue with the sole aim of rataining their hegemonic power to rule this country.They did similar thing way back in May 1969 and the late Tungku abdul Rahman had enough proof of this.What better thing we can expect from Nazis of Malaysia. The big question now is, will Malaysians,especially the Srawakians will allow this kind of political culture and governance to survive forever ????

  15. MACC is now controlled by Nazri Aziz, the corrupt former Minister in charge of Taxi permits. He does this through Ahmad Said, whom Nazri recommended as ACA DG and now on contract as Macc Chief. Ahmad Said is a stupid and lazy officer and it is relected in the mentality of the current Macc officers.

    On Wong’s arrest, this is what Macc says: ” He also refused to sign a notice under Section 53 (3) of MACC Act 2009 which was read and given to him”.

    Now tell me where does it say in sect.53 of that Act that Wong or any other accused has to sign the said notice. It is crystal clear that the MACC officers themselves don’t understand their law.

    Has they got the right to arrest Wong without a warrant of arrest. Ordinarily you must have a warrant of arrest from a magistrate to arrest anyone. Under exceptional circumstances the law u/d s.23 CPC permits an arrest w/o a warrant.

    An arrest without a warrant can be done by any private citizen if the offence is committed in his presence. You saw a snatch thief snatching something. Then you can arrest him. This also applies to police/Macc officers.

    The law u.d s.23 CPC gives latitude to Police/Macc officers to arrest a criminal without warrant u/d certain circumstances. Cases are when someone ‘reported’ to them that a suspect is now entering a house and is abt to steal, rob or do anything criminal to the occupant of the house or that he just saw a snatch thief got off with the victim’s bag. Under those circumstances a police/macc officer can arrest w/o warrant. It would be impracticable and an hindrance to justice if the law expect law enforcers to arrest with a warrant in such cases.

    In Wong’s case, the circumstances are different and the Macc officers have ample time to get a warrant of arrest from any magistrate. The purpose of getting a warrant is for the mag. to check and satisfies himself that there is valid and justifiable reasons to arrest a person. An affidavit must be filed in support of the application. You simply can’t arrest anyone you like

  16. I think MACC was formed to investigate the people who were then trying to oust Abdullah Badawai. But it was a happening too late and he had to go and so the MACC had to lap up to somebody…Who your guess is as good as mine….but for how long….If the lapping produces a stale taste then then some woorfing will be heard and we can the guess who is the lapdog….Wait my dear people…it won’t be long…maybe a few months time…..

  17. MACC can close shop as MACC claimed not to involved in investigation related to political cases. If all malaysian join political party and tell the MACC officer he/she is from XXX party, then whatever cases he/she invloved will not be investigated by MACC!!!
    A Failed Agency in Malaysia, wasting taxpayers’ money……..

  18. all m’sian knew that something is extremely wrong with PKFZ and Kuala Dimensi.
    In Korea, some of their big companies had been convicted for corruption practises but most of this companies had used the advantages given by their government to make their companies a worldwide known brand.
    In m’sia, they either went to overseas to gamble off all their ill gotten money or maybe buy 2 private jets. How can Wijaya Baru afford to buy this plane from their real business?
    The best part is that these 2 guys of KDSB is so daring to tell the world that they are above the law by going to media questioning appointment of lee hwa beng and dragging the King into it. The best is the donation part. Donation is donation and once you had donated that is the end.
    The 2 private jets are basically to service those in power. It must had been used by a lot of BN leaders and maybe he is trying to tell those who had benefited from it to keep quiet or else I exposed you guys.
    Sim, the country is going down the road. Leader that we had high hope for such as Ku Li is reluctant to come out. Those who help the people regardless like Lim Kit Siang and Lim Guan Eng is label as anti-melayu.Guan eng had even gone into jail when she help the poor malay girl in melaka and now he is accused of selling the indian in the Kampung Buah pala issue. Articles is Utusan is so racist that this is the newspaper that should be banned but again they are sanctioned by the goverment.
    M”sia needs the people from S’wak and Sabah to provide the next political tsunami in the coming GE.
    Again, let’s hope for a better M’sia after the next GE

    MACC officials are not trained to investigate BIG cases and so no actions on Toyol Istana and PKFZ. They are only trained to investigate small ikan bilis cases. So how do you expect BIG cases being investigated?

    Many reports were made against the PKFZ scandal since few years back and in fact its considered stale news but MACC did nothing on that.

    What to investigate when big boss own son also got caught with child phono and no actions taken and chief just brushed that aside. Since top not clean, botoom sure not clean too….Chinese saying.

  20. You have to commend the MACC though. They investigate PKFZ with the view to exonerating the guilty because they are part of the BN leadership. Sometimes they let it go through the investigations as well, but make sure they stop themselves from presenting themselves and their investigations fully at the trial. Just ask Kasitah and he will tell you. You think these guys are going to touch Azalina the former Sports/Tourism Minister? no way, Jose. No, no that they are scared. But how could they a “Malay” icon? To charge her and to find her guilty, even if she damn well is, is against public interest as that will undermine the credibility of UMNO. And that they cannot allow. Even if one UMNO leader is found guilty it tarnishes and undermines UMNO’s standings amongst the Mak Chiks and the Pak Chiks.

    so, sure MACC investigates. After that they issue an exonerating Certificate. I wonder how such a Certificate would be worded!!

  22. MACC and PDRM are staffed with the Dominant Race to suppress and dominate the pendatangs with official licence from BN.

    Nothing is wrong – be it violence or even murder – as long as an action is taken to maintain Malay Dominance.
    The end justifies the means.

    MACC and PDRM are acting overtly, blatantly and with impunity and without pretences.

    “So what can you do about it” they are smugly telling the pendatangs.

  24. MACC all got procedure wan. If fr opposition, investigate asap no matter the amount involved. RM10 also we investigate as a crime is a crime, no matter the amount.

    If it is fr BN, we better get permission. We dont play play here. Also better be polite in case thebugger becomes our boss in the future.

    One police head use police plane also kena taken to court, but MCA, we better dont play play. They got connection with big boss.

    who say MACC got no system….got la. You just dont like it thats all.

  25. when MACC mention “political cases” unfortunately, it gives me the impression that MACC feels too much heat as a result of being a political tool.

    LKS certainly has stronger misgivings about this MACC

    MACC is a gift of Badawi in his last days as a PM as the MACC bill was rushed through. Perhaps we should remember him for this.
