Danau Melikin native Ibans charged in Court

5 native Iban farmers were this morning charged in the Magistrates Court in Serian this morning.

Village Headman Nyalu Anak Tampa, together with 2 other farmers Sanjan Anak Ambol and Samad Anak Junna, were jointly charged under section 323 of the Penal Code for voluntarily causing hurt to Andrew Wong King Kiat, an administrative executive of United Teamtrade Sdn Bhd, a company issued with a provisional lease for 73,000 ha oil plam plantation over the land of which the 3 accused claimed are NCR land of Kampung Danau Melikin and 22 other Iban native communities in the area.

Another Danau Melikin farmer Donny Anak Mambu was accused of using an excavator under his control to damage a bridge across Sg Danau on 27.08.2012 and is charged under section 427 of the Penal Code for mischief and causing damage to the amount of RM25 or upwards.

In the other case, an aged farmer Balon Ak Giang was charged for criminal intimidation, that he had on 27.08.2012 verbally threatened to cause hurt to the oil palm estate manager Lee Beng Sing with the words “kamu jangan kerja sini kalau kamu kerja lagi saya bunuh tembak kamu” (You can’t work here and if you do that I will shoot and kill you).

The prosecuting officer informed the court that in both the cases of Donny Anak Mambu and Balon Ak Giang, though separately charged, were one single transaction and witnesses are the same. He applied for the 2 cases to be jointly tried.

All the accused pleaded not guilty and they were each released on RM5000 court bail with one surety each.

The presiding Magistrate Puan Portia Tham ordered the case against Village Headman Nyalu Anak Tampa, Sanjan Anak Ambol and Samad Anak Junna to be managed on 12 November and trial date is scheduled for 3 December 2012.

In the 2 cases involving Donny Anak Mambu and Balon Ak Giang, the Magistrate ordered for case management on 31 October 2012 and trial on 13 October 2012.

Lawyers Baru Bian, See Chee How and Desmond Kho, who appeared in the Serian Magistrate Court this morning, are representing the 5 native accused from Kampung Danau Melikin.

More than 150 other native villagers also crowded the Serian Magistrate Court to show their support for the 5 accused.

  1. File for secession then throw out all charges, throw out all colonialists, all non-locals and make your own country. Only the locals have rights to any land, and the federal ‘laws’ are written to take those lands away! I’m sure the village elders will know who was around before East Malaysia was stolen with obviously illegal laws!

  2. The rich tycoons use money and political connection to influence laws; so most laws are written and interpreted to favor the rich. The poors need to wise up and don’t get “play” by the cronies.

  3. This is what rich people can do to the poor. They have all the money to hire lawyers, but this Iban natives cannot afford to hire lawyers to fight for their right.

    • Is this Paul of PKR yang kalah dulu?
      If yes, pegi lah…….. your kampung temuda and NCR land run down by Shin Yang also you did nothing. When the kampung people ask for help….I heard the BB ask for deposit then he will file the case! As what I was told, you also came from the kampung….. why not file the case?

      • Where actually do you stand on this issue? Are you happy that people lives are being torned apart by land greedy Plantations owners who think of their own servival only? The natives who has lived in this land for thousands of years clearly have more rights to the land then some pendatang who now called themselves Native of Sarawak. Mind you they still call us real natives LAKIA. Whats wrong if PR people are now helping the folks in Malikin. It means the BN they voted for are turning their backs on them so the people of Malikin should do likewise. If you support BN on this issue then why don’t you go and put things right in Malikin. Tell your BN minders that the people are suffering, that they are being intimidated into giving up their lands.

    • This is indeed another sad episode for Danau Melikin. In the last Sarawak state election they are the very people that stopped and chased away PKR people and it’s supporters. PR lawyers must also study their NCR case very carefully should they decided to take their cases. I was told the original and very first settlers of the nearby villages and the surrounding Balai Ringin the like of kpg Sungai Jagu can create quite a stir and can claim that it’s theirs..because they also know this disputed ‘NCR’ land and they can tell you what they know and remember many that resides in Balai Ringin today are Ibans from the second division – . Ask around maybe it will be a good idea.

      • The borne of contention here is why NCR land can be given away by the gov’t so easily without consultations with the local people. Why vast track of lands can be given so easily to the plantation people while at the same time denying the Natives their claim to just a few acres land. Do you think that only the Ibans are making so much noise and creating so much problems to the chinaman who owns huge plantations? There’s problems brewing underneath from Lawas to Lundu and if these Greedy Plantation people continue to be as greedy as they are now,hot lava will spew out and we natives will not be held responsible. Its the stupidity of people who knowingly repress and opress the naives the ones to be blame!

  5. BN had clearly endorsed criminal charge against 5 Iban natives who merely stood up against injustice means Iban natives had no right to protest against the crooks in BN who grabbed their land. You touched five Ibans you touched all. We must respond to BN injustice against the Ibans by voting out all BN candidates regardless of their race and religion. Kick out all BN crooks and thieves.

    • As DJJ said….. the original (1st settler) can also stir the sitaution! You know Iban…..move around the country and later claim the land is there ancestral land! If the Penan were to do th same, they can claim probably 1/4 of Sarawak!

      One good example is in Lapok in Baram…. mana ada Iban dulu in Lapok…. its Penan area. Now they are 4-5 Iban longhouse and claiming its their ancestral land! Kebiasan orang Iban…… mana ada jalan raya…di buat rumah panjang tepi jalan!

      • We natives including the IBANS have no problem moving from anywhere to everywhere in Sarawak until the Chinaman comes to destroy the forest. The junggles were our domain,our hunting grounds were our land so we do not need to settle where we can reach to hunt and roam in the junggles. We natives share the same hunting grounds and we had no problems with that until taib and the chinaman came! To say there were no Ibans in Lopak before is wrong because they were there in the vast junggles before they decided to settle down in Lapok. Did the Penans protest against the Iban settlements? The Penans only protested against those who came and destroyed the
        forest.

        • For the sake of argument only. The extended family of the first original Iban settlers who ‘berimba’ in Danau Melikin were not too happy with the progress thus far because in their great great great grandfathers era, Danau Melikin was just a vast track of empty land that the forefathers toiled. As they started to moved a way bit out of Danau Melikin not so long ago, so I was told..new settlers arrived and settled there9Danau Melikin) but never asked permission from their forefathers beforehand. Very much like the present BN thieves and robbers are doing right now. Even the rich boy millionaire minister Snowdan is not from Balai Ringin but he will be too happy to assist this new generation of the first settlers should they also stake their claims. Which in turn will create what I dub as ‘Quite a stir’. Anyway we hope folks of Danau Melikin under the charge of Mr. Bian triumph because they are willing to fight this BN government – at long last. All the best in fighting corruption.

          • Well, DJJ now you are on the right track. We need to fight this wanton destruction of Natives lands by those greedy chinaman and taib no matter who is helping us, be it BN or PR people who has our interest at heart to fight for us. At the moment it seems the PR people are with us in this fight and the BN people are more interested in protecting their political status and what they can get out of Oppressing their own kind.

        • Brian…in fact yes. The Penan are not happy becuase the Iban are enroaching into Penan/Berawan area in Lapok and in fact there constant fight between the Ibans and OTHERS in Lapok and not reported.

          Yes, the Iban do roam the vast jungles but not beyond Lapok……. Brian we know becuase I am local from Lapok and Lapok only existed just becuase fo the Samling Timber camp.

  6. What else is new? Thats how the Sarawak gov’t do business in Sarawak. Take from the poor natives and give to the already rich Chinaman to enrich them further and charge the poor farmers in court to further repress them until they have nothing left. Thats the kind of POLITIC Of DEVELOPMENT taib is so proud of and the Dayak YBs are supporting.
