Perimeter survey only on farmed land, confirms Adenan

The state government’s perimeter survey exercise of native customary rights (NCR) land will only be carried out on temuda (farmed land).

Confirming this, Special Functions Minister Tan Sri Adenan Satem told the Assembly that he was aware of complaints by some quarters against this.

“That is true and it is consistent with the decision of the Federal Court that only land which has been cultivated and occupied continuously is NCR land.

“If anyone wants any survey to be conducted for their pemakai menoa (communal land) which includes more than the temuda, the government wants to reiterate that its firm policy is that the perimeter survey is to survey the NCR or temuda land.”

Adenan said the Land and Survey Department had received 583 applications for the perimeter survey as of last month. He said 416 applications involving 671,688ha of land had been approved for survey while 167 more were being processed.

“Survey works for 257 areas covering 349,086ha have been completed. Of this, 187 areas totalling 239,292ha have been gazetted as native communal reserve for agriculture under Section 6 of the Land Code,” he said.

On another matter, he said the state government would wait for the outcome of the National Task Force’s study on the findings and recommendations of the Suhakam Report on the National Inquiry on Native Land Claims before making a decision on the parts of the report which were related to Sarawak.

“It is premature at this stage to discuss or debate the Suhakam report until the outcome of the study is available,” he said.

Adenan also announced that the government had gazetted seven new totally protected areas amounting to about 33,300ha in the last six months.They are Dered Krian National Park, Sungai Meluang National Park, Limbang Mangrove National Park, Pulong Tau National Park Extension, Lanjak Entimau Wildlife Sanctuary Extension, Fairy Cave Nature Reserve and Pulau Tun Ahmad Zaidi Nature Reserve.

  1. Can Adenan provide the written ruling of the Federal Court which consistently state that only cultivated land occupied continuously are NCR land?
