Kpg Lebor Serian’s NCR landowners feel ‘discriminated’

Some villagers in Kampong Lebor Serian are crying foul over Malaysian Palm Oil Board (MPOB)’s decision to suspend their smallholder farmers’ licence to sell oil palm fresh fruit bunches (FFB).

According to one of the land owners, Jengga Jeli, on July 26 this year, he received a showcause letter from MPOB demanding an explanation why his smallerholder farmers’ licence should not be suspended or revoked for allegedly stealing FFB from a joint-venture (JV) company, TH Pelita.

The villagers of Kampung Lebor had won their case at the Kuching High Court and, subsequently, at the Court of Appeal that the disputed NCR land belonged to Kampung Lebor villagers.

Jengga argued that the courts had decided that the land belonged to them, and there was no reason for MPOB to accuse them of stealing FFB from their own land.

He said he replied to MPOB accordingly on July 31 but was still called to meet MPOB at the Kuching Resident’s office to hear MPOB’s decision.

Jengga added that he had yet to get the outcome from MPOB, but following the suspension of his licence, other smallholders who used to sell FFB could not carry on their sales, too.

Shocked by MPOB’s alleged impartial and unprofessional act of double standards in sidelining the natives in developing their NCR land, Jengga told a press conference here yesterday that the villagers were contemplating taking legal action against MPOB and bringing the case to an international audience if a solution was not forthcoming.

“The government has always promoted oil palm as part of developing the rural areas and uplifting natives from poverty. However, when the natives have the means to develop their own land with oil palm, the government tries to restrict us from doing so.

“Big companies are given many incentives to develop oil palm on NCR lands, but we natives are sidelined. This reeks of double standards,” said Jengga.

Also present at the press conference was state PKR vice-chairman See Chee How, who is also Batu Lintang assemblyman.

See said he was shocked that MPOB had labelled the villagers intruders, and they appeared to exercise double standards.

He opined that MPOB, as a regulatory and statutory body of the palm oil industry, should be impartial, professional, and standardise in executing their duties.

See said revoking the licence of the smallholders meant denying the natives of their economic income from the sale of FFB.

See, who is also a lawyer, said in 2012, the High Court had ruled that the lands were NCR. The Court of Appeal later affirmed the High Court’s decision.

“The landowners won the case involving about 1,000 hectares of land. They have the right to harvest the about 300-hectare plantation following a consent order entered in court between the native land owners and PH Pelita.

“Therefore, the villagers’ activities on the land is legal and rightful and the FFB harvest belong to them. It is not theft as alleged by MPOB,” said See.

See added that MPOB was making it difficult for the land owners by not recognising their licence.

“They rather let the oil palm rot than let the land owners harvest and sell them.”

  1. YB thank you very much for your tireless efforts to fight for the rights of the natives especially for their NCR lands. However, when the community won, some heartless individuals just robbed the court decision right in front of their eyes thus making their victory meaningless. This is what happening to the Iban Community of Kampung Lebor.

    A group of heartless individuals using an illegal entity call Kampung Lebor B as their tool just robbed the Iban Community of Kampung Lebor of their victory right in front of their eyes. YB, I believe in your capacity as their solicitor you could simply hand over the victory to the Ketua Kampong of Kampong Lebor and not to any illegal party!

    However, what you and your lawyers have been doing to the Iban Community of Kampung Lebor is indeed very unfortunate. Nevertheless, I believe it is never too late to rectify the situation provided that you have the will, and indeed we’re appealing for your moral virtues and will to make our victory a sweet one – not to just a handful few but to the whole community at large.

    • I come to understand that the Federal Court ruling in early March 2015 was in favour of Tabung Haji! The end of the road for the villagers of kpg Lebor!

Some one informed me that Mujah, Bawin & Jengga were leading a demonstration in front of KFC outlet Serian on 22/08/2014, i.e yesterday with banners slandering TH with all sorts of baseless accusations. Surely these bunches of crooks had adopted the import culture of the ‘2- crescent’ followers which are well-known for hooliganism, lawlessness and personal agendas in the Peninsula.

    In the case of kpg Lebor, Mujah, Bawin, Jengga plus a few crooks of kpg Lebor swindle, cheat, steal & rob the kampong folks of their right and benefit after they (kpg folks) are declared by the High Court as having NCR lands in parts of TH Gedong & TH Sadong plantations.

    Jengga, Mujah, Bawin plus a few more crooked personalities of kpg Lebor folks team up to hijack the High Court decision from the hands of the NCR land owners to serve their devilish and greedy agenda! They subtly portray themselves as victims whereas in reality they are the ones who victimized the majority of kpg Lebor folks.

    Jengga, Mujah, Bawin and some crooked individuals of kpg Lebor reap millions of ringgits from this court ruling, whereas the majority of the real land owners got nothing, a few recieved RM130, some RM200, RM300 and viz a viz up to Jengga’s discretion!

    To suspend Jengga’s license is too lenient. In fact MPOB should burn down all his holding.

    1. in 1998 186 kpg Lebor folks sued LCDA & Nirwana Plantations for encroaching into their NCR lands and the State Government for issuing the PLS.

    2. Nicholas Mujah was involved in doing the perimeter survey of the encroached-NCR lands and another Nicholas – Bawin as one of the key plaintiff witness.

    3. Jengga who is declared as leader in this report is not even a plaintiff or plaintiff witness.

    4. When the High Court ruled that Kpg Lebor folks do own parcels of NCR Lands in TH Pelita Gedong & TH Pelita Sadong Oil Palm Plantations as indicated in the map potted by Mujah, then Jengga with the help of Mujah & Bawin hijacked the high court decision from Kampung Lebor folks and immediately appoint First Composite Sdn Bhd to manage the plantation without consulting the Ketua Kampung, JKK Kpg Lebor and Penghulu.

    6. Jengga formed their own committee which they call “Kampung Lebor B” an illegal entity use by Mujah, Bawin & a few crooks to rob Kpg Lebor folks of their rights in managing and appointing a credible company to manage their plantations.

    7. I came to understand that so far more that RM2 million profits has been paid to Jengga & the group. However the majority of the kpg Lebor folks do not get their shares.

    8. Jengga was issued a license by MPOB for his 600-palm holding. By kpg’s standard the most he can get is about 8 tons a month. But for the past two years or more he has been selling more that 20 tons per day! Where did the extra tonnage come from? My kindergarten kids know that they are stealing and robbing from the nearby plantations.

    9. This group through their illegal means (cheating the kpg Lebor folks, stealing & robbing from the nearby plantations) reap millions of ringgits. Numerous police reports were lodged against them, and now their illegal activities have come to the knowledge of MPOB Licensing. The aftermath is the suspend the license that they previously issued to Jengga and of course these rascals got so mad and subtly by all means try to portray that they are the “VICTIMS”

    That is the true picture of story!

    My extra advice to those whose court cases are pending, be careful of Mujah nd Bawin. These two Nicholases are cheats and crooks. They do not have any proper job to feed their families, so with the help of few crooks in the respective kampungs they normally hijacked the court decisions to reap the economics benefit.

    In all the cases so far, the kpg folks though declared the winner by the court, but they lost their spoils to Mujah, Bawin & the gangs!

    In this wicked temporal world they seem to prosper and even sleep soundly during the nights. Believe me friends, in the eternity they have ‘LAKE OF FIRE’ now prepared for them! Repent Mujah, repent Bawin, repent Jengga,…repent ye O the crooked and the perverted, repent from your evil deeds lest ye are on your broad road to destruction.

  8. With the retirement of the old white buaya, we’d all hoped that the BN government would relax its heavy-handed treatment of the Natives. We’d hoped that the new CM would be a bit more humane. Alas, it was a vain hope. Nothing has changed. The same ripoff of the poorly educated Dayaks goes on unabated.
    It is unconscionable of the Dayak ministers who sit around Satem to allow this sort of shabby treatment of their fellow Dayaks to go on.. How can they not be concerned by the dispossession of their land and restriction of their right to earn a decent living like all of us are entitled to? I wonder how they manage to sleep at night!
