Altantuya’s killer finally served courts paper in Australia

Altantuya Shaariibuu’s killer who is currently held at an Australian detention centre has been served with a copy of amendment to a statement of claim, lawyer Ramkarpal Singh said.

He said a process server finally succceeded in handing over the copy of the amendment to Sirul Azhar Umar at the Villawood Immigration Detention Centre in Sydney recently.

“I am now waiting for an official notification from the Australian process server. Then I will inform the court about it at the case management next week,” Ramkarpal told FMT.

The Shah Alam High Court had earlier fixed Oct 26 to hear whether the statement of claim had been served on Sirul.

Ramkarpal said Sirul has 14 days from the date of receiving the document to reply whether to challenge the amendments to the claim.

“Basically, we just want to include that Sirul and Azilah Hadri’s conviction were confirmed by the Federal Court last year,” he said.

He hopes the trial could be held in the second half of the year.

Ramkarpal said Azilah, who is in Kajang prison, was also served a copy of the claim but he had neither responded nor appointed a lawyer.

The lawyer had also tried last year to seek the help of the Foreign Ministry to serve the court papers on Sirul but it did not respond.

Ramkarpal said Altantuya’s family has been “waiting too long” for the lawsuit which was filed in 2007, to commence.

Altantuya’s father, Shaariibuu Setev, his wife Altantsetseg Sanjaa and two grandchildren, are suing the government, political analyst Abdul Razak Baginda, and the convicted killers, Sirul and Azilah, for RM100 million.

The family had alleged conspiracy in Altantuya’s murder.

The 2007 civil suit was postponed pending the disposal of the murder case at the High Court. Subsequently, there were appeals at the Court of Appeal and Federal Court.

Sirul and Azilah, both policemen, were convicted by the High Court in 2009 of killing Altantuya.

They succeeded in overturning their conviction at the appeals court in 2013 but the Federal court restored their conviction last year and sentenced the duo to death.

Sirul did not show up for the final decision and it was later revealed he had left Malaysia. The Federal Court later issued a warrant of arrest for him.

Razak, who was charged with abetment in the murder of Altantuya, was freed at the end of the prosecution’s case. The court ruled the charge against him was not proven.
