Ong: Voters want courts to quash EC’s ‘illegal’ decision

ong-kian-mingThe Election Commission (EC) does not have the right to shift voters from one constituency to another except under a redelineation exercise, Serdang MP Ong Kian Ming said today.

Referring to EC’s “belah bahagi” exercise carried out on April 29 this year, where the electoral boundaries of Batang Kali and Kuala Kubu Baru (KKB) were redrawn and 5,000 voters transferred between the two state seats, Ong said a Judicial Review has been filed on behalf of three voters in the affected seats.

“The EC does not have the right to redraw boundaries of a constituency, be it federal or state, unless it’s in the context of a redelineation exercise.

“As such the judicial review is the only option left to the voters of Batang Kali and KKB to object to the illegal redrawing of boundaries and transfer of voters by the EC on April 29 this year,” Ong said in a statement released today.

He added that the affected voters had no other choice but to file a Judicial Review because the move by the EC was done outside of the Sept 15 redelineation exercise.

“In the EC’s redelineation exercise on Sept 15, the boundaries of the P94 Hulu Selangor seat, which includes the Batang Kali (N6) and KKB (N7) state seats, were not affected.

“This means that the voters who were shifted cannot be heard during the public hearing on the redelineation exercise,” Ong said, adding that the voters sought to overturn the April 29 EC decision, which was published in a Federal Government Gazette.

Ong said lawyers representing the three voters in the two seats filed the judicial review at the Kuala Lumpur High Court on Oct 21, 2016.
