Rafizi Ramli shall remain as Pandan MP until his application to appeal his conviction under the Official Secrets Act has gone through its due process at the Federal Court, the Election Commission said today.
EC chairman Datuk Seri Mohd Hashim Abdullah said that according to Article 48 (4) (b) of the Federal Constitution, Rafizi was entitled to appeal the judgement and thus his position as the MP will remain status quo until the appeal process has gone through the Federal Court.
“Looking at this case, it is unwise for the EC to comment about the necessity to hold a by-election,” he said in a statement.
Mohd Hashim said his statement was to answer queries by the media on whether the Pandan seat would fall vacant or whether there would be a need to call for a by-election soon.
Rafizi received an 18-month concurrent prison sentence after he was convicted of two charges — for possessing and disclosing contents of the classified Auditor-General’s report on 1Malaysia Development Berhad (1MDB) — under the OSA today.
