Lawyer challenges police and MACC to reopen files on 1MDB

A lawyer today challenged inspector-general of police Khalid Abu Bakar and Malaysian Anti-Corruption Commission (MACC) chief commissioner Dzulkifli Ahmad to reopen investigations into 1MDB, following the United States Department of Justice (DOJ) filing against the state fund last week.

Haniff Khatri Abdulla also urged attorney-general Mohamed Apandi Ali to seek the cooperation from the DOJ, as well as his American counterpart, to gather evidence in order to help the police and MACC complete their respective probes against 1MDB and its former subsidiary, SRC International Sdn Bhd, by July 31.

Apandi, Haniff further said, should also appoint a special team of prosecutors headed by a senior deputy public prosecutor (DPP) or a senior lawyer, among the 18,000 lawyers registered with the Malaysian Bar, to independently evaluate the investigation papers, and he (Apandi) himself should not be heading the team, or decide on the results of the police and MACC probes as “he is clearly conflicted, when he acted as if he is Prime Minister Najib Abdul Razak’s personal lawyer.”

Apandi has previously cleared Najib of any wrongdoing in the RM2.6 billion “donation” found in the latter’s personal accounts.

If the three individuals failed to do as proposed by July 31, Haniff told Malaysiakini: “then the obvious conclusion any reasonable Malaysian make is that all three are in complicit to ensure that the crimes in the 1MDB scandal are not exposed, which itself is tantamount to a crime against the people here.”

He noted that IGP Khalid had indicated last April that investigation papers (into 1MDB) have been handed to the Attorney-General’s Chambers, but Apandi is yet to give any statement on the outcome.

He also said it was “foolish” for Khalid to reject the DOJ’s latest filing, when the US is willing to investigate the matter in full, in its bid to seize assets acquired from funds allegedly misappropriated from 1MDB.

Khalid had said the police would not intervene into the DOJ filing issue as it is a “civil matter”.

Haniff, who has represented former premier Dr Mahathir Mohamad in high profile cases, then reminded MACC’s Dzulkifli of his previous call that he would act tough against corruption, regardless of those holding positions, and said it was time, the chief commissioner walked the talk.

The lawyer questioned why the Malaysian government, which claims the DOJ action is foreign interference and libelous on Najib and his wife Rosmah Mansor, is yet to take the three steps he had suggested, namely:

– summon the American ambassador to Malaysia to give an explanation on the matter, and declare the ambassador ‘persona non grata’, citing the suit as wrong and false.

– Najib and Rosmah file an intervener action in the US and strike out all the ‘false’ allegations made against them in the document filed by DOJ,

– for Najib, Rosmah and the government to take action against the purported libel by the DOJ.

Haniff noted that despite all the statement against the DOJ action by government ministers, the US embassy has not received any protest note from Malaysia in regards to the filing.
