Court allows EC’s appeal against 7 voters in Melaka

ec-gavel-court-votersThe Court of Appeal today allowed an appeal by the Election Commission (EC) against a High Court order which gave leave to seven voters in Melaka to challenge the on-going redelineation exercise.

A three-man bench chaired by Umi Kalthum Abdul Majid, unanimously ruled in favour of the EC, which was represented by Amerjeet Singh.

She did not provide any grounds and made no order as to costs.

Ambiga Sreenevesan represented the seven voters.

The appellate court had fixed today to hear the appeal, with both Amerjeet and Ambiga giving submissions before the bench.

Today’s ruling will have an adverse effect on voters who had filed similar challenges against the EC, as the decision will now bind the High Court.

The voters from the Kota Melaka and Bukit Katil parliamentary constituencies had previously filed a judicial review against the EC on April 4.

The High Court then granted leave to the voters on May 3 while issuing a stay order to the EC on conducting local inquiries pending the disposal of the suit.

The EC had published an 18-page notice in major newspapers last September on the proposed redelineation in Peninsular Malaysia and Sabah.
