Bar condemns ‘vicious attacks’ against Ambiga

George-Varughese-ambiga-1The Malaysian Bar has condemned a series of attacks against Ambiga Sreenevasan, following the police’s decision to investigae the activist lawyer after she was named in a defence affidavit filed in London over alleged payments to PAS by Prime Minister Najib Razak.

Its president George Varughese said Ambiga appeared to have been singled out, and warned that harassment or intimidation might amount to contempt of the British courts.

“There has also been a bombardment of vicious and highly disparaging racist and sexist remarks made against her by various individuals, and a police report lodged, in relation to her alleged connection with the suit,” he said.

“We condemn these personal attacks.”

Police reportedly said it would investigate Ambiga for “causing public alarm”, based on a report lodged by an Umno leader.

Last April, PAS president Abdul Hadi Awang filed a suit against UK-based journalist Clare Rewcastle-Brown at the London High Court, over an article in her portal, Sarawak Report, that PAS leaders received RM90 million from Najib.

In an affidavit filed last month, Clare named Ambiga as the person who had revealed the information to her.

Varughese said the matter had yet to be proven in court, and as such there was no legal basis to investigate Ambiga.

“Any such investigation is tantamount to harassment and/or intimidation of a potential witness,” he added.

Varughese said the court would first need to establish whether Ambiga did inform Clare as alleged.

“If the truthfulness is proven, the UK courts will then determine how much weight should be attached to the information,” he said.

“If it cannot be proven that Ambiga had indeed communicated such information to Rewcastle Brown, or if there is no truth in the information, Rewcastle Brown would therefore have failed to establish her defence in respect of that part of her defence and counterclaim.”
