Rally for Sarawak native lands to be held today

File picture shows Peter John Jaban speaking to reporters on January 5, 2016. — Picture by Sulok TawieOver 10,000 people are expected to rally at the Kuching Waterfront here today to call for an amendment to the Sarawak Land Code relating to native customary rights (NCR) land, organisers said today.

Spokesman Peter John Jaban said protesters would consist of native landowners, community leaders, non-governmental organisations and supporters of political parties, coming from all over Sarawak.

He said the highlight of the gathering will be the handing over of a memorandum to Chief Minister Datuk Patinggi Abang Johari Openg, asking him to amend the land code as a matter of urgency.

“The memorandum will be signed by 12 paramount chiefs representing the various indigenous communities in Sarawak,” he told Malay Mail Online.

Jaban said he is made to understand that two international television stations have assigned their reporters to cover the gathering.

He said since December last year, native landowners have lost 14 court cases to plantation companies and the state government.

He said that some of the cases involved customary lands which have been converted to state lease and then alienated to plantation companies.

He said the owners could not get their land back in accordance with the Federal Court’s ruling, but are entitled to compensation for the loss of their properties.

He said the Sarawak Land Code should be amended so they can get back their lands.

Jaban said the community leaders also want the land code to be amended to give force of law to territorial domain (pemakai menoa) and communal forest reserves (pulau galau) as customary lands.

“The indigenous communities are disappointed with the apex court’s ruling that pemakai menoa and pulau galau are not customary lands since they do not have any force of law,” he said, referring to the Federal Court’s ruling which reversed the decision of the High Court and Court of Appeal in the Tuai Rumah Sandah anak Tabau v State Government case.

He said the Tuai Rumah Sandah case will affect over 200 similar cases pending before the court.

On December 20 last year, the Federal Court ruled that the Dayak people cannot apply their NCR on land, to claim virgin forests as their territorial domains and communal forest reserves.

In a 3-1 majority decision, the apex court allowed an appeal by the Forest Department and the state government in a case filed by headman Sandah anak Tabau and other seven other NCR landowners over an area in Ulu Machan, Kanowit.

James Masing could also have declined the post of Senior Minister until NCR lands were returned to the natives during the reign of Taib Mahmud, The Dayaks have finally awaken. There shall be no rooms for negotiations on NCR lands. All the Dayak leaders in Umno Baru controlled BN Sarawak must be voted out. The Dayaks have been colonized by Umno Baru through PBB. Enough is enough. No more BN Sarawak.

  2. No more votes for Umno Baru controlled BN Sarawak until NCR lands were returned and reserved for the natives of Sarawak. Vote out Najib and Umno Baru controlled BN Sarawak.
