‘Sabah, Sarawak free to leave federation’

The issue of secession was not included in the IGC report because “any State voluntarily entering a federation had an intrinsic right to secede at will”.

The view put forth by  a constitution expert and a former Law professor from the International Islamic University recently is arguable.

The professor claimed that Sabah and Sarawak cannot leave Malaysia because of Article 2 of the Malaysia Constitution.

Well this Article was never amended ever since it was written into the Constitution which means that this Article was there when Singapore was “expelled” as he claimed from Malaysia in 1965.

The same Article 2 is still present today in the Constitution, not amended what-so-ever.

The Kota Belud MP and federal minister asserted that talking about seceding from Malaysia is seditious under the Malaysia law and that Sabah and Sarawak cannot secede from Malaysia.

Let me state that anyone who wants to talk about the Malaysia Agreement 1963 without showing their own stupidity must at least read the following primer:

  • The Cobbold Commission Report 1962
  • The Inter-Government Committee Report (IGC) 1963
  • The Malaysia Agreement 1963

There are two things that everyone must learn from the IGC.  Firstly, the IGC is where five political parties from Sabah submitted their memorandum on the 29th August 1962.

Today this memorandum is commonly known as the 20 points.  The 20 points is a memorandum and NOT an agreement as asserted by the Minister.

As a memorandum the 20 point document was submitted to the IGC for consideration by the committee members.

The IGC was headed by Lord Lansdowne the British Minister of State for Colonial Affairs.

Its tasks was “to work out the future constitutional arrangements, including safeguards for the special interest of North Borneo and Sarawak to cover such matters as religious freedom, education, representation in the Federal Parliament, the position of the indigenous races, control of immigration, citizenship and the State Constitution”.

Therefore, the 20 points memorandum was incorporated into the IGC report.  The IGC report has 37 points and NOT just 20 points.

Secession is not seditious

Based on the above, the IGC report is the framework to formulate the Malaysia Agreement 1963.

The IGC is NOT the Malaysia Agreement 1963. It is just a report and accepted by the governments.

The IGC has similar function to the Reid Commission which drafted the Constitution for the Federation of Malaya.  The IGC report was accepted and signed on Feb 27, 1963 by the United Kingdom, North Borneo, Federation of Malaya and Sarawak

Secondly, the 20 point memorandum submitted by the five political parties contain a secession clause which is point No. 7.

In this clause it was specified that there shall be no secession which means that Sabah cannot secede from Malaysia.

However, the issue of secession was not included in the IGC report.

The reason given by Lord Lansdowne was that “any State voluntarily entering a federation had an intrinsic right to secede at will, and that it was therefore unnecessary to include it in the Constitution”.

Basically what it means here is that Sabah and Sarawak is free to form Malaysia, it is also therefore free to leave.

Sabah and Sarawak does not need the approval of each of the states to leave.  Sabah and Sarawak does not need the support of the Rulers Council to leave.

All Sabah and Sarawak need to do is to pass a resolution in their respective Dewan Undangan Negeri to leave and Sabah and Sarawak will become a sovereign nation.

I hope the above explanation is sufficient to clear any confusion about the content and usage of terms pertaining to the Malaysia Agreement 1963.

It is an embarrassment and shameful to see, read and hear Ministers, Professors and ordinary man in the street talking about the formation of Malaysia without them really knowing what the subjects is all about.

There is also nothing seditious about talk son secession. These are real issues based on the IGC, the Malaysia Agreement 1963 and after five decades of forming Malaysia.

These are options available to the people in Sabah and Sarawak and to avoid these discussions  all the government needs to do is simply fulfill its obligations as per the agreement “nothing more, and nothing less”.

  5. I am not expert,and don know all about the legal documents mentioned above ,but I remember during the dispute between Tun Mustafah and Tun Razak ,it is said that Sabah and Sarawak allowed to do so
    within 10 years after the formation of Malaysia federation.Tun Mustafah is said tried to leave Malaysia before the deadline.

    • All really need to read the out of print book “Granville-Edge, P. J. (1999). The Sabahan: The Life And Death of Tun Fuad Stephens. ISBN 978-983-40114-0-6” which explains a lot of these issues. Tun Fuad also had second thoughts re ‘the union with Malaya’ but stabbed in the back by Tun Mustafah who was later stabbed in the back when he threatened to leave as well! Explains why Tun Fuad converted to Islam on the hope of becoming Malaysia PM but going further back was it was Lee Kuan Yew rather than Tunku who persuaded Stephens into promoting Sabah to join Malaya – alteria reason was Singapore could not become independent unless it joined with Malaya & co but once independent was able to secede out – Brunei never joined and look at those 2 countries compared with Malaysia. Brunei has done very well with oil revenue – where did Sabah & Sarawak’s revenue go along with the timber revenue…..

  7. Malaysia was based on a big lie aka invasion and takeover bogeyman to scare the innocents in Brunei, Sabah & Sarawak to agree to form Malaysia.

    Sabah & Sarawak leaders unlike Brunei sultan were so naive! Brunei saw through the Malayan agenda. Neither Brunei nor S’pore experienced the invasion Sabah & Sarawak had- Malayan invasion followed by illegals and Sulus.

    Donald Stephens had one grand chance to be a real hero by insisting on reviewing MA63 in 1965 when the Malaysia concept was killed off but he was meekly subdued. Of course we don’t know what bribe or threat UMNO used.

    I weep to think of this lie. “Sabah dan Sarawak mencapai kemerdekaan mereka melalui Malaysia” (We will gain independence if we sign the agreement to form FEDERATION like UK – Wales, Northern Ireland & England)

    Sabah & Sarawak were independent nations before 16 Sept 1963 and were cheated to give up their independence in exchange for a PONZI SCHEME!

    How can you achieve independence by being swallowed up in an artificially created country and ruled by a new master?

    And this myth has been perpetuated in UMNO doctored history on par with the Japanese penchant for same!

    UMNO cannot afford to teach the truth. The truth will kill Malaysia. I say crooks cannot think straight!

    A coalition of NGOs, politicians and activists from Sarawak and Sabah have drawn up a petition recently, addressing it to the United Nations (UN) secretary-general Ban Ki-moon to re-open the issue of self-determination for the two East Malaysian states.

    The petition, touted to have been signed by some 100 representatives at a leading hotel in Miri last Saturday, was also copied to the UN Special Committee of 24 (C-24) and the UN Human Rights Committee. It aimed to gather several hundred thousand signatures in both states before making its way to the UN secretary-general.

    A copy of the petition sent to The Borneo Post on Monday pointed out that the people of Sarawak, Sabah (then known as North Borneo) and Brunei as former British colonial subjects, first appealed to the UN by the Memorandum dated Sept 9, 1962.
    Signed by Sarawak United Peoples’ Party, United National Pasok Mamogun Party and Parti Rakyat Brunei, the request however remained unaddressed by the UN owing to the intervention of historic events which recast the political course of Sarawak, Sabah and Brunei for the last 51 years.

    “Whereas Brunei attained independence on 1st January 1984, Sarawak and Sabah have remained under ‘change of status’ stature without national independence up to today; documented as such in the United Nations Trusteeship Agreement listed by the General Assembly as Non-Self-Governing Territories,” the petition stated.

    UK-based Borneo’s Plight in Malaysia (BoPIM) president Daniel John Jambun who sent the copy was reported in the media yesterday as saying that Sabah and Sarawak were dragged into the Malayan Federation on Sept 16, 1963 by the British and Malayan governments to facilitate the merger of Singapore with Malaya.

    The Malayan Federation then changed its name to Malaysian Federation. “It’s obvious from Article 160 of the Federal Constitution that Malaysia was not formed as was earlier promoted by the British and Malayan governments,” explained Daniel on why he signed the petition.

    The petition, in calling for a review on self-determination, sought assistance from the UN to review “the arbitrary and indecorous surrender of our sovereignty by the United Kingdom of Great Britain and Northern Ireland under Command of Her Majesty The Queen of England, to the Federation of Malaysia on 16th September, 1963”.

    It noted that this indecorous surrender of sovereignty was sanctioned by the UN “without exercise of the right to self-determination in contravention of the spirit and letter of the United Nations and Decolonisation Declaration adopted by the General Assembly Resolution 1514 (XV) of the 14th December 1960”.

    The organisers behind this petition and signature campaign, in its pursuit to follow up on the memorandum dated Sept 9, 1962, requested at the earliest opportunity given to make representations before the UN to seek Sabah and Sarawak inherent right to self-determination as enshrined in the Charter of the United Nations.

    “The right of self-determination of peoples is a fundamental principle in international law and this legal doctrine is also embodied in the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights,” the Petition said.

    18/20 Point Agreement :-

    The 20 point agreement / 18 point agreement is between made between TWO countries ( Malaya and Sabah / Malaya and Sarawak). The point was stated in Malaysia Agreement 1963.

    Read the original Malaysian Agreement 1963.

    Such being the case, no changes can be made on the agreement without the consent of the other. In the case, they seemed to be effort by the Federal Government to put aside this agreement or even ignore this agreement as it gets their way of integrating Sabah and sarawak according to West Malaysia UMNO point of views and political agenda.

    Sabah and sarawak must NEVER give up on this agreement as it provides us with more autonomy. The founding fathers has the foresight to see the greed of West Malaysian and sadly for Sabah since UMNO has come in and rule Sabah it has lost most of its autonomy. sarawak should continue to fight to uphold the 18 points agreement. Those leaders from Sabah & Sarawak MUST insist that any Government SHALL respect and enforce the 18/20 point agreement when they do come into power.

    Monitor and review the implementation of the agreement the government of Sarawak may like to consider setting a monitoring and reviewing committee to consolidate the implementation status and audit the program that has been set to comply with the agreement that will help Sarawak Malaysian to understand how much has been done in respect to the 18 point agreement.

    Probably it would be good initiative to trace this document back in the UK to find more detail on the intent, spirit, process and even minutes of discussion leading to the signing of these agreement.

    A memorandum for House of Lords in UK
    Where is the Cobbold commission report now – probably in UK too. Malaya would never want to show it because the result is 33% want Malaysia, 33% do not want Malaysia and 33% undecided. How they concluded that Sabah and Sarawak should join Malaysia based on the statistics only “Allah” know. The British has some explaining to do to both Sarawak and sabah. Maybe a memorandum should be sent to the House of Lord to ask for explanation on the matter. What is the agreement all about?

    The 20-point agreement, or the 20-point memorandum, is an agreement made between the state of Sabah (then North Borneo) with what would be the federal government of Malaysia prior to the formation of Malaysia in September 16, 1963. A similar agreement was made between the state of Sarawak and the federal government but with certain differences in their 18-point agreement.

    The agreement

    Point 1: Religion

    While there was no objection to Islam being the national religion of Malaysia there should be no State religion in Borneo (Sarawak & Sabah), and the provisions relating to Islam in the present Constitution of Malaya should not apply to Borneo.

    Point 2: Language

    * a. Malay should be the national language of the Federation

    * b. English should continue to be used for a period of 10 years after Malaysia Day

    * c. English should be an official language of Borneo (Sarawak & Sabah) for all purposes, State or Federal, without limitation of time.

    Point 3: Constitution

    Whilst accepting that the present Constitution of the Federation of Malaya should form the basis of the Constitution of Malaysia, the Constitution of Malaysia should be a completely new document drafted and agreed in the light of a free association of states and should not be a series of amendments to a Constitution drafted and agreed by different states in totally different circumstances. A new Constitution for Borneo (Sarawak & Sabah) was of course essential.

    Point 4: Head of Federation

    The Head of State in Borneo (Sarawak & Sabah) should not be eligible for election as Head of the Federation.

    Point 5: Name of Federation

    “Malaysia” but not “Melayu Raya”

    Point 6: Immigration

    Control over immigration into any part of Malaysia from outside should rest with the Central Government but entry into Borneo (Sarawak & Sabah) should also require the approval of the State Government. The Federal Government should not be able to veto the entry of persons into Borneo (Sarawak & Sabah) for State Government purposes except on strictly security grounds. Borneo (Sarawak & Sabah) should have unfettered control over the movements of persons other than those in Federal Government employ from other parts of Malaysia Borneo (Sarawak & Sabah).

    Point 7: Right of Secession

    There should be no right to secede from the Federation

    Point 8: Borneanisation

    Borneanisation of the public service should proceed as quickly as possible.

    Point 9: British Officers

    Every effort should be made to encourage British Officers to remain in the public service until their places can be taken by suitably qualified people from Borneo (Sarawak & Sabah)

    Point 10: Citizenship

    The recommendation in paragraph 148(k) of the Report of the Cobbold Commission should govern the citizenship rights in the Federation of Borneo (Sarawak & Sabah) subject to the following amendments:

    * a) sub-paragraph (i) should not contain the proviso as to five years residence

    * b) in order to tie up with our law, sub-paragraph (ii)(a) should read “7 out of 10 years” instead of “8 out of 10 years”

    * c) sub-paragraph (iii) should not contain any restriction tied to the citizenship of parents – a person born in Borneo (Sarawak & Sabah) after Malaysia must be federal citizen.

    Point 11: Tariffs and Finance

    Borneo (Sarawak & Sabah) should retain control of its own finance, development and tariff, and should have the right to work up its own taxation and to raise loans on its own credit.

    Point 12: Special position of indigenous races

    In principle, the indigenous races of Borneo (Sarawak & Sabah) should enjoy special rights analogous to those enjoyed by Malays in Malaya, but the present Malays’ formula in this regard is not necessarily applicable in Borneo(Sarawak & Sabah).

    Point 13: State Government

    * a) the Prime Minister should be elected by unofficial members of Legislative Council

    * b) There should be a proper Ministerial system in Borneo (Sarawak & Sabah).

    Point 14: Transitional period

    This should be seven years and during such period legislative power must be left with the State of Borneo (Sarawak & Sabah) by the Constitution and not be merely delegated to the State Government by the Federal Government.

    Point 15: Education

    The existing educational system of Borneo (Sarawak & Sabah) should be maintained and for this reason it should be under state control.

    Point 16: Constitutional safeguards

    No amendment modification or withdrawal of any special safeguard granted to Borneo (Sarawak & Sabah) should be made by the Central Government without the positive concurrence of the Government of the State of North Borneo

    The power of amending the Constitution of the State of Borneo (Sarawak & Sabah) should belong exclusively to the people in the state. (Note: The United Party, The Democratic Party and the Pasok Momogun Party considered that a three-fourth majority would be required in order to effect any amendment to the Federal and State Constitutions whereas the UNKO and USNO considered a two-thirds majority would be sufficient).

    Point 17: Representation in Federal Parliament

    This should take account not only of the population of Borneo (Sarawak & Sabah) but also of its seize and potentialities and in any case should not be less than that of Singapore.

    Point 18: Name of Head of State

    Yang di-Pertua Negara.

    Point 19: Name of State

    Sarawak or Sabah.

    Point 20: Land, Forests, Local Government, etc.

    The provisions in the Constitution of the Federation in respect of the powers of the National Land Council should not apply in Borneo (Sarawak & Sabah). Likewise, the National Council for Local Government should not apply in Borneo (Sarawak & Sabah).

    *Merger

    In 1961, when the Malayan government began discussing a possible merger with neighboring Singapore, Sabah, Sarawak and Brunei, problems of ethnic power relations arose again. The “Malaysia” proposal sans Sabah and Sarawak went back more than a decade; earlier negotiations had proved fruitless. The Singaporeans themselves were not anxious to be ruled by what they considered a Malay government. By 1961, however, Singapore had grown receptive to the idea of joining Malaysia, largely because of the prevailing idea at the time that industrial Singapore could not survive without access to Malayan markets.

    Singapore Chinese population is a threat to Malaya

    The Malayan government was not keen on having the Chinese Singaporean population push the Malays into a minority position in the new Malaysia. Many Malays felt that upsetting the Malay-dominated nature of the armed forces and police might place them in a dangerous situation. It was also argued that the inferior economic position of the Malays would be emphasized by the entry of even more rich Chinese, setting the stage for major discontent.

    Malaya get Sabah and Sarawak to form Malaysia to make use of their native population numbers. The Malayans decided to resolve this by merging with Sabah and Sarawak; both British colonies had large native populations whom the government considered “Malay”. Under Article 160 of the Constitution, most of them were not Malay; the natives were mainly animists or Christians instead of Muslims as required. To resolve this issue, the government expanded its informal definition of “Malay” to include these people.

    *The natives of Sarawak and Sabah are to be considered ‘Malays’ by the Malayan Union to solve their problems.. the Ibans, the Kenyahs, the Bidayuh, and etcs…

    Is this true today or we from Sabah and Sarawak being cheated by UMNO Malaya and the Federal Government of Malaysia?

    The Malaysia Agreement 1963 is invalid and has been repudiated by Malaya through 51 years of non-compliance and failure to honour the treaty, Sarawak Association for People’s Aspiration (Sapa) told a forum today.
    Sapa president Lina Soo (pic) said the agreement that united Malaya, Sarawak and Sabah into one country was in breach of customary international law, which states that only sovereign states can enter into international treaties.
    “The Malaysia Agreement 1963 was not inked between five sovereign states, but entered into between only two independent sovereign states – the United Kingdom and Federation of Malaya – with one semi-colonial Singapore state and the two colonies of North Borneo (Sabah) and Sarawak,” said Soo.
    She said the five individuals who signed for Sarawak – P.E.H Pike, T. Jugah, Abang Haji Mustapha, Ling Beng Siew and Abang Haji Openg – had no mandate from the people of Sarawak, which at that time was still a colony without any representative government.
    Soo said this was in violation of the Vienna Convention on the Law of Treaties Customary International Law, 1980 (VCLT 1980) – an international treaty concerning the international law on treaties between nation-stated entered into force on January 27, 1980.
    “VCLT may not be retro-action that it is applicable to treaties made prior to this date such as the Malaysia Agreement 1963, yet it is a useful reference to established principles of customary international law and established precedents,” said Soo.
    She added that the treaty also breached Article 5 of the United Nations Decolonisation Declaration 1960 (UNDD 1960).
    The article states that territories which have not yet attained independence should have all powers transferred to them “without any conditions or reservations, in accordance with their freely expressed will and desire, without any distinction as to race, creed or colour in order to enable them to enjoy complete independence and freedom”.
    Soo said: “Britain and Malaya’s pre-determined plan to transfer sovereignty of the Borneo colonies over to Malaysia violated Article 5 of the UNDD 1960, as it failed to transfer all powers to the people, and is in denial of the people’s rights to complete independence and freedom.”
    She also said that Malaya, as a foreign power, had no legal right, mandate, standing or authority to interfere in Borneo affairs, according to the UN Charter on Self-Determination.
    Britain, meanwhile, had committed a breach of trust by failing to honour their 1946 Cession Treaty to restore independence to Sarawak when the people were ready to rule themselves, said Soo.
    “The component states of a federation possess no powers in relation to foreign policy, and so they enjoy no independent status under international law.
    “Sarawak is not independent and has no sovereignty to call its own,” said Soo.
    She also called the bases for Malaysia’s foundation, the Cobbold Commission Survey and the United Nations Assessment Mission, as “shams” because neither were conducted properly.
    “The Cobbold Commission met with 4,000 people from Sabah and Sarawak in a population of 1.2 million and claimed to receive 2,200 memos and letters from the people.
    “Before commencement of the UN Assessment Mission, the new Malaysia date of 16 September was already announced,” Soo told the forum.
    The assessment report also said a grassroots survey found “little evidence of articulate and organised opposition to the federation”, despite thousands protesting around Sarawak and the arrests of anti-Malaysia leaders as well as banning of Chinese newspapers at that time, said Soo.
    Soo added that if authorities still insisted the Malaysia Agreement was valid despite these points, it should have been abrogated by Singapore’s separation and independence from Malaysia in 1965.
    “An international treaty cannot be changed without the agreement and consent of all the parties.
    “The bilateral Singapore Separation agreement between Singapore and Malaya in 1965 was made without active involvement of the other three signatory parties,” said Soo.
    She also claimed that Malaya had repudiated the agreement by its 51 years of non-compliance and failure to honour the treaty.
    “The most basic principle of customary international law is that an international treaty must be made and kept in good faith.
    “But the Malaysia Agreement and concept of Malaysia was made in bad faith and changed three times without referendum or the people’s consent,” said Soo.
    She noted that Brunei refused to sign at the last minute, Singapore had seceded from Malaysia without consulting Sarawak and Sabah, and the Federal Constitution was amended on August 27, 1976 to change the status of Sarawak and Sabah into the 12th and 13th states.
    “Malaysia has deviated from its original concept as a Federation of three nation-states to a unitary state of 13 states where all powers and sovereignty is solely held by the central government.
    .
    “This in effect would mean a fundamental breach of the Malaysia Agreement,” said Soo. – June 15, 2014

    • Depends on what religion you are talking about. If you talk about the deluded, distorted and twisted doctrine, I agree with you. But if you are talking about that special relationship between man and God, a happy, joyful father and son relationship of mutual understanding and love, wisdom, virtue, peace loving and righteous living, then I beg to differ. Nobody is perfect, you, me and everyone else but at the least, we must know what ir right or wrong and what is good or bad. If I chance upon Steven Weinberg one day, I would ask him only two questions. The chicken or the egg first? And How many billions or trillions years the sun has been shining and for how many billions or trillions more years? Hope he will come out with a wise and logical answer to both.

When you apply critical thinking and reason that ‘special relationship’ is only the chemistry reaction in your brain. Nothing else exist beyond the physical.Your mind is held hostage by the threat of eternal punishment if you are in that relationship. Self preservation of the religion use this threat.Fundamentalist ability to think rationally has been destroyed. Explanation of solid and scientific facts just does not register with them. Like robots they will continue to believe.God doesn’t send man to hell.It the people who send themselves to hell based on their choices they made. It is called obsessive compulsive disorder.The real dangerous psychotics are the political and religious leaders the ones in control.A delusion is a false personal belief based on incorrect influence about external reality and firmly sustained despite physical realities to contradict such claims. Any belief in non physical reality is a form of delusion caused by intellectual weakness. Religion can alter your state of consciousness. Take my words for it as we are coming to enlighten age, when critical thinking and reason will soon prevail over nonsensical religious beliefs. Churches all over Europe are now museums pieces.America is more secularised these days. Only countries largely imbibed by religious beliefs are still struggling with conflicts,wars and poverty.

Godless people, satanic terrorists and extremists are the real trouble and problem creators on this planet Earth. They are the fools and idiots who are deluded and have no fear of God and eternal doom. I would rather have Godly and peaceful people around me who shun evil and eternal doom than to have those Godless, evil and satanic type who cause all the woes, hardship and chaos without conscience and remorse. The greatest people in the world in the world, whether intellectual or non intellectual are Godly people. Unfortunately, they are the great minority. You can use all the critical thinking or reasoning power in the world till you crack your head with a Phd (permanent head damage), you still need to make the correct choices. Sarawak is in such a deplorable state of being robbed and ill-treated is because there are too few good and courageous people. We must turn the situation around so that we have the upper hand against the evil corrupt who are in control now. Remember, if you are kind enough to serve me coffee, it’s either real hot or ice cold, no in between or lukewarm which I will spit it out of my mouth.

  11. I have reaffirmed time again and again to fellow Sarawakians and Sabahans that we have every right to secede if there is any breach of the 18/20 point agreement. The surrender of rights by the traitors Abdul Rahman Yakub and Harris Salleh are deemed to be null and void as they didn’t pass the peoples referendum and consent. It’s about time for the people of Sarawak to pull out of Malaysia and press charges against the traitors concerned and their families who have enrich themselves the ill-gotten ways through corruption and abuses of power. Let’s form a united front to uphold our cause for the welfare of the people and our future generations. Contrary to treason, we are being patriotic to our homeland Sarawak and Sabah for being Ill and unfairly treated, repressed and robbed of our wealth.

    • It doesn’t matter whether there is a breach of the 18/20-point agreement or not. According to Lord Lansdowne, Sabah and Sarawak can leave the federation anytime they feel like, even if Malaya is slavishly observing every single clause in the Malaysia Agreement.

They use whatever means, fair or foul to steal us blind and as if that’s not enough, they use all sorts of threats to subdue us to submission.     • Come on, loyaburok, let’s not compare the salvation of Sarawak with that of the holy scripture. How can you take the Holy scripture literally when we are supposed to know the metaphoric or spiritual aspect of what the bible says. Even Jesus teaches his disciples and the crowd in parables, using metaphors to explain or describe his messages in figurative ways. Turn the other cheek doesn’t mean you are weak or relenting but rather the contradictory sense of being able to withstand and endure. As long as good people don’t delude, hallucinate and divert from the true teachings of the Word of God, who are we to criticize or mock at them.
